REFUNDS

Effective Date: December 15, 2013.

This Sales and Refund Policy governs the fulfillment of your order by Wiseacre, LLC (“we” or “us”).  By placing your order, you agree to be bound by this Sales and Refund Policy, in addition to our website Terms of Use, Privacy Policy and Copyright/Intellectual Property Policy.

1. Payment

Payment may be made by Visa® or MasterCard®.  Your credit card will be charged when the order is placed. We do not accept cash, checks, or any other payment form. Prices are based on U.S. currency. You agree to pay all fees, shipping charges, and taxes, if applicable.

2. Product Pricing, Descriptions and Display

Pricing and product availability are subject to change without notice.  We reserve the right to limit quantities.  Prices displayed on this Website are subject to final approval at the time of order fulfillment.  We attempt to be accurate in our product descriptions.  We do not warrant, however, that product descriptions or other content on this Site are accurate, complete, reliable, current or free from errors or omissions.  Textures, finishes, colors, patterns, sizes, and other visual features of products might display differently on your computer monitor than the items appear in hand.  Images are shown for representational purposes only.  If a product offered by us is not as described, your sole remedy is to return it in unused condition.  We reserve the right to refuse service, terminate accounts, or cancel orders in our sole discretion.  All items purchased from us are made pursuant to a shipment contract.  The risk of loss and title for such items passes to you upon our delivery to the carrier.

3.Refund Policy

We take pride in our products and have confidence that you will be pleased when you place an order through the Site.  Notwithstanding the foregoing, we will refund your purchase under any one of the following conditions:

• The item itself is damaged or materially flawed;

• The quality of the design print falls below reasonable expectations;

• You received the wrong item; or

• The design is materially different from the design submitted by you.

All refunds are subject to a deduction for shipping costs and a 20% restocking fee.

4. Taxes

In states where we have no physical presence, we are not required to collect and remit sales tax for purchases through this Site.  Many states, however, require that their residents file a sales or use tax return for items purchased on this Site.  For purchases where sales tax is applicable you will see the tax calculated on the checkout page before you are asked to confirm the purchase.  We use reasonable commercial efforts to calculate and remit the correct amount of tax required on each taxable purchase, but we do not guarantee the accuracy of the amount of the tax we represent to you as the tax owed.  In consideration of our allowing you to use and access this Site and collecting and remitting taxes required on your purchases, you hereby waive your right to claim that the tax collected on any purchase is incorrect in any respect, and you agree to hold us and our officers, directors, affiliates, parents, subsidiaries, employees, agents and representatives harmless for any harm or other damages you may incur as a result of our error in calculating the taxes you owe for your purchases.
